Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") define the rights and obligations between users of the services provided by Lumily (hereinafter referred to as "the Service") and our company. The Service is based on the concept of "turning fragments of daily life into lifelong assets" and provides a place to store and utilize users' precious records.

Article 1 (Application)

These Terms shall apply to all relationships between users and our company regarding the use of the Service.

Article 2 (Definitions)

In these Terms, the following terms shall have the respective meanings. 1. "The Content": Refers to text, images, emotion tags, and other data that users post, transmit, or upload using the Service. 2. "Single Stream Timeline": Refers to the main function of the Service that integrates and displays the records of users and their families.

Article 3 (Account Management and Security)

1. Users shall appropriately manage their account information for the Service at their own responsibility. 2. Although our company strives to protect accounts using a strict ownership verification system, we shall not be liable for any damage caused by the leakage of account information due to the user's negligence.

Article 4 (Copyright and License of the Content)

1. The copyright of the Content posted by users to the Service (including the rights under Articles 27 and 28 of the Copyright Act) shall continue to belong to the user (or the legitimate right holder). 2. Users shall grant our company a free and non-exclusive right to use (reproduce, adapt, publicly transmit, etc.) the Content only to the extent necessary for the provision of the Service, system maintenance, functional improvement (including AI processing), and promotion.

Article 5 (Use and Restrictions of AI Functions)

1. The Service uses AI (such as Gemini) for automatic generation of diary summaries and emotion tags. 2. This function is intended to assist users in reflection, and our company does not guarantee the accuracy or completeness of the generated results. 3. Our company will not allow users' Content to be used for general training of third-party AI models in a state where specific individuals can be identified.

Article 6 (UI Visual Effects)

The Service adopts a visual effect (weathering effect) where past posts appear "foggy" when records are interrupted for a certain period. This is a visual design expressing the fading of memory and does not mean that the user's data itself is deleted or damaged.

Article 7 (Data Backup and Disclaimer)

1. Although the Service makes every effort to protect data as "lifelong assets," it is impossible to completely eliminate the risk of data loss due to communication lines, server failures, or force majeure. 2. Users shall appropriately back up the Content externally at their own responsibility. 3. In the event of failure such as loss or damage of the Content, our company shall not be liable for any damages unless it is caused by our company's intentional misconduct or gross negligence. 4. Even if our company is liable for damages, the scope of such liability shall be limited to ordinary damages directly and actually suffered by the user, and the maximum amount shall be the usage fee paid by the user to our company in the last year (or 1,000 yen in the case of free use).

Article 8 (Prohibited Matters)

Users shall not engage in the following acts. 1. Acts that violate laws or public order and morals 2. Acts that infringe on the intellectual property rights, privacy, honor, etc., of our company, other users, or third parties 3. Acts that place an excessive load on the networks or systems of the Service 4. Other acts that our company deems inappropriate

Article 9 (Withdrawal and Handling of Data)

1. Users can withdraw from the Service by following the prescribed procedures. 2. The Service does not currently provide an external export function for the Content. 3. Upon completion of the withdrawal procedure, access to the Content will become impossible immediately, and our company will sequentially delete the data stored on the server. 4. Data cannot be restored after withdrawal. Users shall separately save necessary records before withdrawal at their own responsibility.
